Construction Job Site and Plant Accidents

Construction sites and industrial plants are frequent places where injuries occur, due to the level and nature of activities being performed, many of which are dangerous, impose a significant risk of injury. Many different types of equipment and tools being used, sometimes well off the ground, increases the likelihood for injury.

While in both South Carolina and North Carolina, an employee injured on the job cannot sue his employer in tort and is limited to workers' compensation benefits against his employer, he may be able to bring claim against another responsible party such as a manufacturer of a defective product which caused injury at the plant or construction site, the negligence or fault of another contractor or subcontractor and in some cases, the owner, general contractor, or other contractors or persons who may be performing maintenance or cleaning activities which bring about or contribute to the injury.

Additionally, there are certain time limitations within which claims for both workers' compensation and negligence based claims may be brought, or else forever barred.
